Privacy Policy

This policy explains how Sierra USA Homes Ltd (“we”) collects, uses and protects personal data you provide through this website. It is written to meet the Kenya Data Protection Act, 2019.

Who is responsible for your data

Sierra USA Homes Ltd is the data controller. For any question about this policy, or to exercise any right described below, contact sales@sierrausahomes.com.

What we collect

When you submit an enquiry, request the brochure, or complete the survey:

• Your name, email address and phone number.
• The unit type you are interested in, and any message you write.
• Survey answers: your budget range, purchase purpose, financing preference, timeline, and country of residence.

Automatically, when you visit:

• How you reached the site — the referring page, and campaign parameters such as utm_source, utm_medium and utm_campaign.
• Advertising click identifiers (fbclid from Meta, gclid from Google) when you arrive from an advert.
• The pages you viewed on this site.
• An anonymous visitor identifier stored in your browser, and — if you arrived through a partner agent's referral link — that agent's code.

We do not collect payment card details through this website, and we do not knowingly collect data from anyone under 18.

Why we use it, and on what basis

• To respond to your enquiry and arrange a viewing — necessary to take steps at your request before entering a contract.
• To send you information about this development and future projects — with your consent, which you can withdraw at any time.
• To attribute an introduction to the estate agent who referred you, so that agent can be paid — our legitimate interest in operating a referral programme.
• To measure which adverts and channels bring genuine enquiries — our legitimate interest in running our marketing efficiently.

Cookies and similar technology

We set a small number of first-party cookies. Two record which partner agent introduced you, if any, and how long that introduction remains valid. One holds an anonymous visitor identifier so a visit today can be connected to an enquiry later. None of them carry your name or email until you choose to give it to us.

Our customer relationship platform sets its own analytics cookies to measure sessions and traffic sources. You can clear or block cookies in your browser settings; the site will still work, but an agent who introduced you may not receive credit.

Who we share it with

• GoHighLevel (LeadConnector), our customer relationship platform, which stores your contact record and our correspondence with you.
• Meta and Google, in aggregate, to measure advertising performance. We do not sell your data to them or to anyone else.
• Our sales team in Kenya and the United States, who will contact you about your enquiry.
• The estate agent who introduced you, where one did — limited to the fact of your enquiry and its progress, not your survey answers.

Some of these providers store data outside Kenya, including in the United States. Where that happens we rely on the provider’s contractual data-protection commitments.

How long we keep it

Enquiry records are kept for as long as needed to deal with your enquiry and, if you do not proceed, for up to three years afterwards in case you return. Referral records are kept for seven years, because they support commission payments and the tax records that follow them. You can ask us to delete your data sooner.

Your rights

Under the Data Protection Act, 2019 you have the right to:

• Be told what personal data we hold about you, and receive a copy of it.
• Have inaccurate data corrected.
• Ask us to delete your data, where we have no continuing obligation to keep it.
• Object to your data being used for direct marketing — we will stop on request, without needing a reason.
• Withdraw consent at any time, without affecting anything done before you withdrew it.
• Complain to the Office of the Data Protection Commissioner.

Security

The site is served over HTTPS. Access to your data in our customer relationship platform is restricted to named members of the sales team. Referral and commission records are held in a database with row-level access controls, so a partner agent can see only their own records.

Changes

We will update this page when our practices change, and change the date at the top when we do.
